New Erosion Control and Stormwater Management Laws in Maine | |||
|
There will be two new laws addressing the control of nonpoint sources of pollution in Maine. These laws were passed during the recent legislative session and will become effective July 1, 1997. The new laws resulted from a substantial review of Maine's Site Location of Development law. The new erosion control provision will require that a person who conducts an activity involving filling, displacing or exposing earthen materials take measures to prevent unreasonable erosion of soil or sediment beyond the project site or into a protected natural resource. More specific information is available on the Maine DEP web site. The new stormwater management law will require a permit from the DEP prior to construction of 20,000 square feet or more of impervious area in the direct watershed of a waterbody most at risk from new development, or 1 acre or more outside such a watershed, or 5 acres or more of disturbed area in either location. The DEP will be adopting stormwater quality and quantity standards in the future. Again, more information is available on the DEP web site.
